The following terms of use apply only to the use of and purchases from Circuit City Stores, Inc.'s ("Circuit City") website at www.circuitcity.com. The terms "you", "your" and "yours" refer to the user/customer utilizing our website to purchase services or merchandise ("Product") or to browse our website. The terms "we", "us" and "our" refer to Circuit City. These terms may not apply to purchases made at our Circuit City retail stores or in any other manner not utilizing the circuitcity.com website.

We provide our website and its contents on an "AS IS" basis and make no warranty or representation regarding any Product, either express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, which are hereby expressly disclaimed, unless otherwise stated herein.

Despite our efforts to ensure that the information on our website is accurate, complete and current, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. We make no warranty or guarantee that the information on our website is error-free, complete, or current. We reserve the right to correct errors and/or update the content on our website at any time without notice. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

We reserve the right to change Product pricing, terms, specifications and warranties without notice. In addition, we may revise these terms of use at any time by updating the website. Monitor displays are simulated. Monitors are not included with computer systems unless specified. Online sales are intended for, and limited to, personal use and domestic sales only. We reserve the right to limit the number of Products sold, including the right to prohibit sales to re-sellers. Prices do not include shipping, tax or insurance. We do not review or edit any portion of gift messages and disclaim all responsibility for their content. We disclaim all responsibility for the accuracy of any map or direction presented on our website.

If you are purchasing Products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country. We will not ship to foreign locations. Warranties for exported Products may vary or be null and void.

In no event shall Circuit City, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not we have been advised of the possibility of any such damages.

We accept the following forms of payment for your online purchases: Circuit City Credit Card, Circuit City Plus Visa, Circuit City Gift Cards, MasterCard, Visa, Discover and American Express. For your online purchases, you may purchase multiple products in a single order, and we'll accept one credit card and up to four Gift Cards for each order.

We do accept online-only or virtual credit cards as long as they are issued by one of the credit card companies listed above. However, due to the requirements of these companies, these cards can only be used for website orders that are shipped. We do not accept online-only or virtual cards as a form of payment on Express Pickup orders.

We are unable to accept cash, checks, C.O.D. orders and wire transfers for any website purchases. If you would like to make a purchase using either cash or a check, please visit your local Circuit City store.

We do business throughout the United States and accordingly collect sales and use tax as required by applicable law. Your confirmation of your order total will reflect the applicable state and local sales tax, if any. The tax rate applied to your order will generally be the combined state and local rate for the address where your order was shipped, delivered or picked up.

For any online purchase of a tax-exempt item during a sales tax holiday period, by completing the purchase, you certify that the item is being purchased for personal use only and you agree to assume liability for the applicable tax if the item is used for other than personal use.

In-Store Pickup: To ensure we have your selected Products available for pickup at the store you designated, we have instituted certain authentication procedures.

At the time of pickup, you or an authorized user of the credit card used to make the purchase must present the store with a printout of your order confirmation screen (to be printed by you at time of purchase), the actual credit card used to make the purchase and a valid photo ID identifying the individual authorized to pick up the merchandise - either you as the purchaser or an authorized user of the credit card account - and matching our records for the online purchase. If a Gift Card was the sole payment method used to make the purchase, then you will be required to present a valid photo ID at the time of pickup, and the name on the ID must match the name on the order confirmation.

If you are unable to print the order confirmation screen at the time of purchase or have lost it prior to Product pickup, the individual picking up the Product must present a valid photo ID that matches our records and the information provided to make your purchase online. We reserve the right to withhold release of merchandise in circumstances where the documentation provided does not match applicable credit card information or the information provided at the time of purchase.

Product not picked up within 14 days of the order will be returned to inventory and a credit for the purchase amount will then be made to the credit card used to purchase the Product. If a Gift Card was the sole payment method used to make the online purchase, we will issue a refund via a mail refund check. We do not guarantee availability of the Product after it has been returned to inventory.

Shipped and Home Delivery products: You may have your product shipped or delivered to your home via one of our available shipping or home delivery options. We ship orders on normal business days, which are Monday through Friday excluding government holidays. Weekend shipment of orders is not currently available. For our Express Air service (i.e. next business day arrival), your order must be completed before 1 p.m. Eastern Time in order for it to ship the same day. Orders requesting our other shipping methods will ship within 2 business days from when the order was completed.

Home delivery is available only for select TVs 24" and larger and within the Circuit City store delivery area, but may not be available in some areas. For those areas where home delivery is available, we may deliver Sunday through Saturday, but actual availability depends on your location.

You assume all risk of loss for shipped Products. Order information such as billing or shipping address that is inaccurate or incomplete may result in delays. Products can not be shipped to incomplete addresses.

We are unable to refund any online purchase from the time your order is placed (when you click the Submit Order button) until your Product is received by you and returned to us. If you are not completely satisfied with your purchase after receiving your Product, please review our return policy to determine your preferred method of return.

Rebate and coupon offers provided by manufacturers are subject to the terms specified by the manufacturer. These terms may include the timeframe of the offer, limitations on quantities and combination with other offers. Proof of purchase, UPCs from the original packaging and postage are normally required for redemption of rebates by the manufacturer or the manufacturer's agent.

If you're not completely satisfied with a product, Circuit City will gladly exchange or refund the purchase within 30 days of the sale date, except as noted below.

Digital cameras, camcorders, desktop PCs, notebook PCs, monitors, printers, scanners and radar detectors must be returned within 14 days of the sale date, and (except where prohibited by law) are subject to a 15% restocking fee if returned opened or in a non-factory sealed box.

There is no restocking fee for defective product returned in exchange for the exact same product, or for product originally purchased as Open Box.

For any exchange or refund, we need the original receipt or a record of the purchase in our system, and the product must be in its original condition, including the box, UPC bar code, packaging, and all accessories.

Opened software, music, games, and movies may be exchanged for the same title only.

Charges for installation and delivery services are nonrefundable after the services have been performed.

Wireless phones: Circuit City is not responsible for contacting the carrier regarding changes or cancellations of your service plan.

DIRECTV®: DIRECTV® receivers will only be accepted for exchange or refund if returned with the original access card within 30 days of purchase. For your own protection, please be aware that the distribution or use of counterfeit or altered access cards for satellite TV reception is a violation of Federal Law. If you suspect any violations, please call (800) 829-4414. Circuit City is not responsible for contacting DIRECTV® regarding changes or cancellations of your subscription.

Missing accessories: The value of missing items will be deducted from the credit amount of a return. For even exchanges, we will exchange what the customer returns (e.g., box for box, manual for manual, etc.)

Promotional packages: Returns for promotional package items will only be accepted if all components of the promotional package are returned. Individual package components may be exchanged if defective.

In-store returns: Any Product purchased online may be returned to any Circuit City store (except our Circuit City Express locations) provided that it meets the above guidelines.

For any Product received that is not the Product ordered, we will exchange the item at no additional cost upon verification. Proof of purchase (e.g. order confirmation, packing slip or record of purchase in our system) is required for all returns. When returning Product to your local Circuit City store, please be sure to bring the credit card used for the purchase along with your proof of purchase.

Mail returns: You may return any merchandise purchased online via mail provided that the return meets these guidelines. (Please note that merchandise purchased at your local Circuit City store (not online) CANNOT be returned via mail. Please return such items to your local Circuit City store. Please see store for in-store purchase return policy.

Merchandise purchased online through circuitcity.com (regardless of whether you picked it up at the store or had it delivered to your home), which meets the Refunds and Returns guidelines above, may be returned via mail to our authorized return center. Before returning anything by mail to us, you first must obtain a Return Authorization ("RA"), found in the About Your Order section.

Any returns mailed to us without a pre-approved RA may be refused without notice, automatically returned and a handling fee assessed. An RA is valid for 10 days.

You will be responsible for all shipping and insurance charges for returns, unless otherwise indicated. If you choose not to insure your package, and we do not accept return of the Product, you will be responsible for any loss or damage. Upon our acceptance of the merchandise in like new condition in conformity with this policy, the purchase price will be credited to your credit card or a mail refund check will be issued for a purchase made with a gift card as the sole payment method. Allow 14 days (not including delivery time for mail refunds) from when we accept your returned Product for the processing of your credit. Additional charges may be assessed for Products returned with any missing items such as manuals and/or accessories. For Product that we verify to be defective, we will reimburse you for your original shipping expense on the Product that you return or exchange.

All new Products are sold with the manufacturer's limited warranty. The warranty period and service varies by manufacturer and Product. The full text of any such warranty is available, free of charge, upon written request addressed to:

The terms and conditions for our Circuit City Advantage^SM Protection Plan for Home and Car Electronics, Circuit City Advantage^SM Protection Plan for Computer Products, and Circuit City Advantage^SM Protection Plan for Small/Portable Electronics, will be made available to you before you complete the purchase of any such Product. The applicable terms and conditions shall govern the purchase of each such Product.

These terms are governed and construed by the laws of the Commonwealth of Virginia without regard to its conflict of law rules. You agree that if any part of these terms is found to be unenforceable, the remainder of these terms will remain in full force and effect.
